Purpose This study aims to explore whether face recognition technology – as it is intensely used by state and local police departments and law enforcement agencies – is racism free or, on the contrary, is affected by racial biases and/or racist prejudices, thus reinforcing overall racial discrimination. Design/methodology/approach The study investigates the causal pathways through which face recognition technology may reinforce the racial disproportion in enforcement; it also inquires whether it further discriminates black people by making them experience more racial (...) discrimination and self-identify more decisively as black – two conditions that are shown to be harmful in various respects. Findings This study shows that face recognition technology, as it is produced, implemented and used in Western societies, reinforces existing racial disparities in stop, investigation, arrest and incarceration rates because of racist prejudices and even contributes to strengthen the unhealthy effects of racism on historically disadvantaged racial groups, like black people. Practical implications The findings hope to make law enforcement agencies and software companies aware that they must take adequate action against the racially discriminative effects of the use of face recognition technology. Social implications This study highlights that no implementation of an allegedly racism-free biometric technology is safe from the risk of racially discriminating, simply because each implementation leans against our society, which is affected by racism in many persisting ways. Originality/value While the ethical survey of biometric technologies is traditionally framed in the discourse of universal rights, this study explores an issue that has not been deeply scrutinized so far, that is, how face recognition technology differently affects distinct racial groups and how it contributes to racial discrimination. Virtue argumentation theory has been charged of being incomplete, given its alleged inability to account for argument cogency in virtue-theoretical terms. Instead of defending VAT against that challenge, I suggest it is misplaced, since it is based on a premise VAT does not endorse, and raises an issue that most versions of VAT need not consider problematic. This in turn allows distinguishing several varieties of VAT, and clarifying what really matters for them.

Anglo-American authors have paid little attention to a subtle distinction that has important jurisprudential implications. It is the distinction between sources of law and the legal norms which can be derived from sources by means of interpretation. The distinction might also be rendered as a threefold one, separating sources of law from legal norms and both of these from that which mediates their relation, namely, methods of legal interpretation. This paper intends to state the “source-norm” distinction clearly and to give (...) examples of jurisprudential insights that are missed, and mistakes that may be made if the distinction is not given its due. Argumentation is a dialogical attempt to bring about a desired change in the beliefs of another agent – that is, to trigger a specific belief revision process in the mind of such agent. However, so far formal models of belief revision widely neglected any systematic comparison with argumentation theories, to the point that even the simplest argumentation structures cannot be captured within such models. In this essay, we endeavour to bring together argumentation and belief revision in the same formal framework, (...) and to highlight the important role played by Toulmin’s layout of argument in fostering such integration. The FactsIt has recently come to light that an article published on this journal in 2007, “On the illuminationist approach to imaginal power: outline of a perspective”, by Mahmoud Khatami, Topoi, 26, 221–229, extensively plagiarized parts of Mikel Dufrenne’s book The phenomenology of aesthetic experience . Entire passages from Sect. 4 of Khatami’s article turned out to be copied from chapter 11 of Dufrenne’s monograph, which was not even included in the list of references. This case of plagiarism first surfaced (...) in early November 2014 on a widely read philosophy blog, Daily Nous, in a thread of comments to a post denouncing similar alleged academic misconducts by the same author . Derek Parfit’s thesis that identity doesn’t matter in survival has been extensively discussed except for its metaphysical robustness. How can we justify the abandonment of identity in the way Parfit suggests? My argument is the following. Those who want to endorse the thesis that identity doesn’t matter (and, therefore, abandon identity across time) should adopt exdurantism, i.e. a metaphysics according to which the world is composed by temporal parts each existing at a time and according to which there is nothing (...) as a numerically same entity which exists at different times. I show that the metaphysics behind Parfit’s theory is neither compatible with endurantism, according to which object persists by being wholly present at different times, nor with perdurantism, according to which entities are aggregates of temporal and spatial parts. BackgroundHeavy media use has been linked to sleep problems in children, which may also extend to the infancy period. While international parent-advisory agencies, such as the American Academy of Pediatrics, advise no screen time before 18 months, parents often do not follow this recommendation. Research on Italian infants’ early access to media is sparse, and only very few studies have investigated links with sleeping habits.MethodTo address this gap, we examined concurrent associations between parent-reported surveys of child technology use and sleeping (...) patterns. The Italian version of the 60 item Comprehensive Assessment of Family Media Exposure Survey, developed as part of a larger international study,, the Brief Screening Questionnaire for Infant Sleep Problems Sadeh, 2004) were completed online by 264 Italian parents of 8- to 36-month-olds and a subset completed the Parenting Stress Index Abidin, 1995) between April 2017 and April 2018.ResultsMore devices located in the child’s room and the more time spent watching TV or using an iPad were associated with less hours of sleep at night. Furthermore, more time spent watching TV or using a smartphone, as well as the number of devices in the room was associated with going to sleep later at night. Instrumental media use was associated with less sleep.ConclusionLike other countries, Italian infants have high levels of exposure to media, and differences in media patterns were associated with sleep patterns. Cultural factors influence both instrumental reasons for media use and sleep practices. Further research should explore how media use may serve to regulate emotion as a function of both contextual factors and individual differences. (shrink)

Dix ans plus tard, il n'est pas bien clair si cette fin est consommee ou si, d'une facon ou d'une autre, l'Histoire s'est remise en marche. Ce qui l'est encore moins, c'est le sens qu'il y avait a formuler un tel diagnostic. Que peut-on entendre par fin de l'Histoire? S'agit-il d'un accomplissement, d'un achevement du devenir (spirituel) de l'humanite - ce (...) qu'on a nomme jusqu'a present Histoire? Ou bien n'y va-t-il pas plutot d'un essoufflement et d'une perte du sens de l'historicite? Pouvons-nous encore nous representer notre devenir comme historique? Et si oui, a quel prix, theorique, ethique et politique? C'est la question qu'ont a charge d'instruire les etudes ici reunies, dans une enquete philosophique sur les conditions et limites de cette figure typique de la pensee contemporaine que constitue la fin de l'Histoire. Alejandro Tomasini ha indicado, muy lúcidamente, la necesidad de pensar los problemas filosóficos en lengua castellana. Más aún, ha sugerido que es posible tratar los problemas propios de la filosofía analítica por medio de la lengua castellana y que, por otra parte, es necesario en nuestro continente pensar los problemas y enfrentarlos analíticamente. Independientemente de su alcance teórico, el mérito del libro que presentamos, Lecturas analíticas: una introducción a temas y problemas de la filosofía analítica, apunta a esa dirección.

Este artículo trabaja con el concepto de juventud aceptado dentro de la sociología y la psicología social y lo lleva a un contexto concreto, la sociedad chilena. El concepto se modifica a partir de una serie de mecanismos de carácter negativo y se crea un particular imaginario social. Ese imaginario social representa a los jóvenes, en la mayoría de los casos, como un sector marginal y conflictivo de la sociedad. El análisis este universo social, legitimado por la familia, los medios (...) de comunicación y otras agencias de socialización, resulta indispensable para comprender la situación y buscar alternativas.This article works with the concept of youth accepted inside the sociology and the social psychology and takes it to a concrete context, the Chilean society. The concept is modified from a series of mechanisms of negative character and there is created an imaginary social individual. This imaginary social one represents the young men, in the majority of the cases, as a marginal and troubled sector of the society. The analysis of this social universe, legitimized by the family, the mass media and other agencies of socialization, turns out to be indispensable to understand the situation and to look for alternatives. En el ensayo logos y oúcría en el Sofista de Platón se discute la relación entre lenguaje y ser, y el modo como Platón concibe dicha relación. Primero se reconstituye las críticas que platón le hace a las teorías ontológicas anteriores así como la famosa gigantomaquia alrededor del ser. Todas tienen algo en común: desconocen el papel esencial del Lógos en el conocimiento del ser. Luego se discute la función de la imagen en el conocimiento, y qué relación hay entre (...) lenguaje e imagen. Por último se busca dar una interpretación del término lógos, utilizado al final del diálogo, y que se traduce normalmente como frase u oración. (shrink)

En este breve comentario discuto algunos aspectos de la interpretación de la epistemología de Davidson que sugiere Willian Duica en su reciente libro. Luego de una presentación somera del libro me centro en tres asuntos centrales de la interpretación de Duica. En primer lugar, argumento que su lectura de la crítica de Davidson al dualismo esquema/contenido es muy restrictiva y deja abierta la posibilidad de un realismo directo empirista. En segundo lugar, argumento que en su lectura el propio Duica se (...) compromete inadvertidamente con un empirismo de este tipo y, de este modo, su interpretación entra en tensión con el coherentismo de Davidson. Finalmente, discuto algunos aspectos de la interpretación que hace Duica de la tesis davidsoniana de la triangulación. In this short comment I discuss some aspects of William Duica's interpretation of Davidson's epistemology in a recent book. After a brief review of the book, I focus on three central issues of Duica's interpretation. First, I argue that his reading of Davidson's criticism of the scheme/content dualism is too restrictive and leaves open the possibility of an empiricist direct realism. Second, I argue in his reading Duica inadvertently commits himself to an empiricism of this sort and, as a result, his interpretation is in tension with Davidson's own coherentism. Finally, I discuss some aspects of Duica's interpretation of Davidsonian triangulation. (shrink)

This short piece discusses Hélène Landemore’s proposal of an ‘open democracy’, as outlined in her recent book _Open Democracy: Reinventing Popular Rule for the Twenty-First Century_. Acknowledging the value of Landemore’s radical and ambitious proposals, I draw attention to a number of shortcomings and blind spots that have to do with how the case for an ‘open democracy’ is made: through an unduly brief and dismissive treatment of political parties; a methodological insensitivity to empirical variations of democratic performance and citizens’ (...) evaluations of the latter; a failure to distinguish between higher and ordinary law-making in the discussion of the central Icelandic case; and, finally, a surprising concession that realising an open democracy is all but infeasible in established constitutional democracies. If open democracy is to be an attractive ideal, these issues must arguably be addressed. (shrink)

L'article s'interroge sur la tradition française en matière d'épistémologie et analyse la réaction du milieu philosophique du début du xxe siècle face à la crise des acquis philosophiques traditionnels provoquée par le développement des sciences. Les interventions au premier congrès international de Philosophie de 1900 montrent que la philosophie essaie de continuer à exercer une hégémonie sur les sciences, mais que, pour réagir à la crise, elle doit s'engager dans l'histoire des sciences. L'histoire des sciences devient alors le moyen employé (...) par la philosophie pour essayer de garder sa place privilégiée dans l'ensemble du savoir: elle est donc faite par des philosophes qui, de ce fait, en contrôlent les lieux institutionnels. Il devient dès lors possible de tracer une ligne qui relie les questions des philosophes de 1900 à celles qui préoccupent ceux de l'entre-deux-guerres, notamment Gaston Bachelard. (shrink)

Hans Kelsen was one of the most important legal thinkers of the 20th century, and he is known for mounting an elaborate defense of liberal party democracy at a time when the latter was hardly the most popular form of regime. This article examines how Kelsen responded to two major political movements he experienced in his intellectual prime: political Catholicism, which he was confronted with in interwar Austria, and Christian Democracy, which became a hegemonic political force in Western Europe after (...) World War II, when Kelsen was already in exile. The article reconstructs Kelsen's complex critique of these two religious movements and ends by reflecting on what we can learn from his arguments about current attempts to revive Christian political thought. El presente trabajo pretende servir como introducción a una teodicea de la filosofía y la teología racionalista (mu'tazilí) árabe a partir de un texto de Algazel. Esta teología y filosofía cree que Dios ha creado el mejor de los mundos posibles debido a su esencia buena, siendo, por tanto, optimista y determinista. Sin embargo, este optimismo en la teología viene dado por la mera voluntad de Dios, mientras que en la filosofía por la causalidad y la necesidad lógica.

Resumen En esta investigación se presentan los resultados del estudio de las funciones pragmático-discursivas desempeñadas por oraciones escindidas del tipo “lo que pasa es que” en narraciones conversacionales de experiencia personal generadas por hablantes chilenos. Se analizan 54 narraciones conversacionales con dos propósitos: clasificar las oraciones escindidas según la parte de la estructura narrativa que introducen y ofrecer una taxonomía de funciones pragmático-discursivas que desempeñan dichas construcciones. Entre las principales conclusiones se destaca que las oraciones escindidas desempeñan tres macro-funciones: focalizadora (...) –aparentemente la más relevante para la cadena narrativa–, introductora de atenuaciones justificantes y orientadora, cada una con diferentes posibilidades de realización. In A Treatise on Virtues and Rewards, Dragonetti advances a theory of action based on rewards for virtues. The idea of rewards, especially of awards, relies on the hypothesis that intrinsic motivations drive the actions of good or virtuous citizens. We apply this theory to virtuous entrepreneurs who voluntarily adopt ethical principles as promoted by a recent Italian law. These firms receive an ethical rating by the Italian Competition Authority and can access a set of economic and non-economic benefits. We (...) survey a sample of 152 private companies with an ER and examine their views on the economic and social motivations and benefits as well as the perceived usefulness of the ER for improving ethical behaviour. An exploratory factor analysis detects four categories of motivation and two categories of benefits, which we use in regression models to test Dragonetti’s theory. Overall, respondents see the ER as an effective tool, except in terms of improving economic performance. We also find that entrepreneurs with lower economic and higher responsiveness motivations attain higher ERs. However, in the respondents’ opinions, the ER is not producing any concrete benefits since we find no relationship between the ER and economic or competitive rewards. These findings have implications for the ICA as well as for private companies. (shrink)

In this brief commentary of Kamila Debowska-Kozlowska’s insightful analysis of persuasive outcomes (Processing topics from the Beneficial Cognitive Model in partially and over-successful persuasion dialogues. Argumentation, 2014), I articulate some suggestions for future development of her ideas. My main claim is that, while instances of partially and over-successful persuasion are indeed worthy of further theoretical inquiry, the topical analysis proposed by Debowska-Kozlowska may benefit from integration with other approaches.

Uma das reflexões de maior envergadura de Hannah Arendt é aquela que se volta para o tema da liberdade. Nas páginas de O que é liberdade?, nos deparamos com um movimento argumentativo que tem como premissa asseverar que a liberdade é a raison d'être da política e seu domínio de experienciação é o espaço público. Contudo, em Origens do totalitarismo, há um outro polo argumentativo, que apresenta o pensamento como a mais livre das faculdades espirituais, a qual é constantemente ameaçada (...) de ser substituída pela camisa de força da ideologia. Por último, em A vida do espírito, Arendt afirma que a vontade tem uma liberdade infinitamente maior do que o pensamento. Esses três movimentos argumentativos acerca da liberdade constroem uma contradição conceitual que, em nosso entendimento, não é passível de solução, mas somente de explicitações acerca de cada um desses movimentos. Refletir acerca dessa contradição conceitual se constitui como objetivo nuclear do presente artigo. (shrink)

This paper outlines an integrated approach to trust and relevance with respect to arguments: in particular, it is suggested that trust in relevance has a central role in argumentation. We first distinguish two types of argumentative relevance: internal relevance, i.e. the extent to which a premise has a bearing on its purported conclusion, and external relevance, i.e. a measure of how much a whole argument is pertinent to the matter under discussion, in the broader dialogical context where it is proposed. (...) Then, we argue that judgements of internal relevance heavily rely on trust, and that such trust, although occasionally misplaced , is nonetheless based on several reasons, and thus often justified, by either epistemic or pragmatic considerations. We conclude by sketching potential methods to formally model trust in argumentative relevance, and briefly discussing the technological implications of this line of research. (shrink)
